Briefly I will give a overview of the circumstances leading up to me being falsely accused of abusing my daughter. Her mother made these accusations after a prolonged visitation dispute. Her mother would only let me see my daughter at her house and under her conditions. I have always paid my child support, all I asked was for me and my family to be a part of her life. I filed papers for mediation and then she refused all contact with my daughter for seven months. She finally agreed to let me see her every other Saturday and two hours on Mondays. This was to be for a year, then renegotiated. She played games the whole year not home, said she was sick etc. She made everything as difficult as possible. We went back to mediation after this year beacuse, I wanted weekend visits. She refused and the mediator told her that the judge would rule in my favor. This mediation session was March 4 1996. She then made two reports to social services saying I had abused my daughter. The first one was March 16 1996 less than two weeks after our failed mediation session. The police contacted me on Memorial Day 1996 and asked me some questions. They said my daughter said I touched her bottom while she was on the toilet. What happened was she was going to the bathroom and said "daddy it hurts when I go potty" I was on the phone at this time and went into the bathroom and bent down and took my fingers and rubbed them below the crease below her belly. I asked does it hurt here or lower? She said lower. I thought she was constipated and she never, said anything after this about hurting. What I found out later was that she had a vaginal yeast infection. She had recurrent ear infections and was on antibiotics. One of the side effects of antibiotics is vaginal yeast infections. This is why it hurt when she went to the bathroom. As you can see by the social services reports below they did not think any abuse had occurred. I filed papers to go to court and she got a restraining order out on me, saying I abused my daughter. She had a doctor testify against me saying he believed I abused my daughter. All the while this was going on I was working as a Ultrasound Tech In a Childrens Hospital. You can imagine the stress this put on me. Below Are The Social Service Reports And Medical Reports . After you read them I will comment on them and the judges ruling and the aftermath. I will discuss the impact on my life and consequences.

Child gave no indication in the interview that anything inappropriate has happened to her. No one has touched her on her "body"- her name for her vaginal area. Not afraid of her dad. No one has ever hurt her. Looks forward to visits with her dad. No indication that any one else has had contact with her-inappropriately when with her dad. RATING: 0 Maltreatment Force 2. Include pervasive behaviors, feelings, intellect, physical capacity and temperament. Very talkative-was not shy about talking with Chief Haas and myself. Bright for her age-looked well cared for. Talked about fun things she does when she visits dad-Appeared comfortable in conversations about him. Goes to day care is concerned about the kids she is exposed to there. Child gave no indication that anything inappropriate has happened. Suggested to mother that she connect with a child therapist who can explore her concern more thoroughly. Perhaps with time with a therapist child will report abuse-if it has actually happened. We found no reason to proceed further after our interview with child. Case closed. Mary Osborne 4-30-96. Maltreatment Element: What is the extent of the maltreatment? Based on my conversation with the child and discussions with the Hallie officer , I do not believe that maltreatment occurred. What believe occurred was dad may have at one time wiped her bottom after going to the bathroom. Dad was not seen by me it was a Sunday and I was out of town. Child stated that when her dad touched her she was in the bathroom when he was wiping her bottom. 2. Nature Element: What was the surrounding circumstances that accompany the maltreatment. As stated in the maltreatment description, child told the officer and myself that her dad touched her in the bathroom. he was wiping her butt. We tried to reframe this several times during the interview however she kept coming back to the fact her father touched her in the bathroom-while she was on the toilet. This was the second report in a 3 month period. Mary Osburne recently completed an investigation which was unfounded. RATING 0 Child Force Child Functioning Element : How does the chid function on a daily basis? Include pervasive behaviors, feeling, intellect, physical capacity and temperament. Child appeared quite comfortable with me her mother and the officer that assisted me during the interview. She does have a short attention span which became very apparent as she became restless during the course of the interview. Her verbal skills were good and she appeared quite connected to Mom and became upset when her mother stated she would not be visiting her father. She stated, but why I love my dad. RATING 0 Parent Force 1 Father I did not see him in person, however, I did have a conversation with officer Ken Taylor after he spoke with the father. It was determined after assessment and investigation that what occurred between child and her father was dad was wiping her bottom while on the toilet. There is no indication that maltreatment occurred. No referents were made Bonnie Nutter 9/12/96 Medical Reports 6-27-94 Skin rash -genital area 4 days congested history of recurrent otitis prescribed Vacitn antibiotic and Monistat for yeast dermatitis
5-9-96 Mom brings child in for a ear recheck
after completing a 14 day course of antibiotics. She state that she
has no complaints of ear pain but did just finish the medication
yesterday. Child has been complaining of burning on the outside of
the vaginal area after urination and states it is red down there on
Monday May 6 1996 . Mother then asked child if some one touched her
down there and she stated "yes" when asked who she states
"my daddy" I then asked her who touched her down there and
she stated my daddy and she said he touched me with his finger down
there. She proceeded to show me with her finger and how he had
touched her and moved her finger across her labia. Mother has
suspected this for some time and said child recently spent time with
her dad on the 4th of May . His son who is usually there was not
there this time A. Yeast Dermatitis and possible sexual abuse by the father. Mother continues to document child's comments and reports them to case worker . She was notified of above information in regards to touching incident. I was finally able to reach someone at human services about alleged sexual abuse. Report was given to intake worker, 5-28-96 Child comes in with her mother with a concern over sexual consult. Mother reports there is a growing concern over the possibility of sexual assault occurring between the patients father and child. Mother has brought multiple handwritten notes in which she reports that child acted strangely after visiting her father and has had perineal irritation. Her handwritten notes are from 6-10-95, 6-23-95, 8-8-95,3-8-96 and 5-7-96. On multiple of these episodes child apparently related to mother that father had used his finger or hands touching her external genitalia. Mother has contacted social services about this case. I discussed this situation with child. When asked why she came to her appointment today she stated "to talk about by daddy touching my body." She reports her father did use his hand or finger in direct contact with her external genitalia. She reports this has caused her some discomfort. She is too young to provide accurate dates to when this occurred. She did state that one time or another that it occurred in the shower while showering with her father. She stated that after this occurred she had a" lot of pain in my body there." She does also report some discomfort with urination since that time. She relates that she did not have contact with his external genitalia. Is remarkable that she did voice similar concerns earlier this month with Nurse here in office. Child has no other history of sexual assault or contact. She has the normal amount of childhood illnesses with previous PE tubes in 1994 General Review is unremarkable as is cardiopulmonary. GI and GU as outlined above. 4 yr 9 month old B/P 88/52 wt.15.9kg. Skin is normal . Lungs are normal Heart is normal without murmur. Abdomen is soft and benign GU is normal female external genitalia is normal. She has normal anatomy. I appreciate no tears or scarring. Hyman is intact . Anus is normal. Extremities are without clubbing , cyanosis. or edema. A. History Consistent With Sexual Consult By Direct Manipulation. Dictated May 29 th 1996 Copy of note mailed to Police Dept. 8/27/96 Spoke Briefly with mother in regards to the possible sexual assault occurring between the patient's father and child. Apparently there was not enough evidence to bring charges so mother continues to deal with the issues. She states that child continues to report incidences to her grandmother and father. She has not seen her father since May. Mother will continue to follow up with legal sources with her concerns. 8/29/96 Phone Call I talked with mother over the phone to further discuss what is happening with the charges that have been brought against childs father. She states that apparently there is not enough evidence to press charges. She states however that child continues to talk about her father touching her stating 'daddy touches me a lot" and also stated that "daddy puts his fingers up there so it hurts". Again she has not seen me since May 2, but she continues to talk about these episodes. Encouraged Mother to pursue the issue with the district attorney as to what she further can do from here. Mother is very concerned that the father is trying to work out with his lawyer increased time with child. Mother will get back if there is anything further we can do with the district attorney and what she has told us.
