Judges's Ruling
Now that you have read the evidence, you are ready for the judges ruling. After the police investigation and social services reports were dropped because of lack of evidence my lawyer filed an order for visitation. My daughter's mother immediately filed a restraining order alleging abuse. This was served at my place of employment a childrens hospital a very stressful situation. A court hearing was scheduled in Eau Claire County this is where the social service's investigation took place. The hearing was short, they determined that since the alleged "abuse" took place in Chippewa County this is were the hearing should be. This became a problem because the guardian ad litem was also from this county and I do not believe the social services reports were at the hearing. This all occurred in Oct 1996.
At the first hearing my daughters doctor and nurse both testified that they believed abuse had occurred. The doctor testified also that their was no physical signs of abuse. Basically what he was going on was what her mother told them. The only thing my daughter said was that I had touched her down by her labia and I had took a shower with her. The doctor never read the social services reports. Here my daughter is interviewed without her mother and she consistently says I touched her while she was on the toilet. He is only hearing one side of the story,he does not bother to read the social services reports. He also know's nothing about me or that in fact my daughter's mother was dating a convicted child abuser at this time and she was on AFDC. The doctor never new about how she had denied me visitation from day one, or that I worked in a children's hospital.
Her mother testifies that she has suspected for over a year that I was abusing my daughter but she never went to the authorities until I filed for overnight visitation. She had several hand written notes all dated during the past year saying why she suspected abuse and what my daughter had been telling her after visitation with me. Yet the social services reports contradict this my daughter tells them no one has abused her, looks forward to visits, talks about fun things she does with dad etc. I never got the social services reports until 1998 . I am not sure if the judge saw them or not. Complicating the fact was that the first hearing was in Oct 1996, and only the doctor, nurse, and mother testified because they ran out of time. They rescheduled but before the hearing I became sick. I had severe headaches and went to the local emergency room and they diagnosed a viral infection. The headache persisted my family doctor diagnosed a sinus infection. Well they were both wrong. I went to work and one of the radiologist's looked at me and noticed my left pupil was constricted and my tongue was swollen. He immediately sent me to a neurologist. The neurologist took one look at my eye and tongue and said I had a horner's syndrome. Something was pressing on my twelfth cranial nerve. He suspected a tumor. I had a MRI and they found that I had a dissecting aneurysm of the left internal carotid artery that was 75% occluded with blood clot. No wonder I had a headache. Also the blood was enlarging my vertebral artery putting pressure on the twelfth cranial nerve hence the constricted eye and swollen tongue. Now we have two doctors that are totally wrong. Do you think maybe my daughters pediatrician could be wrong? I can forgive the doctors who misdiagnosed my body, but not the one who misdiagnosed my daughter, this affected my soul not my body. Especially when he only know's one side of the story
I was in the hospital for nine days and have made a full recovery. The next hearing was not rescheduled until April of 1997 six month's had passed. I got to testify at this hearing. I testified that my daughter was on the toilet when I touched her and also that I had documented proof that her mother had been dating a convicted child abuser. I also testified "may I burn in hell forever if I ever did one thing to my daughter". The judge apparently put great weight on the doctors testimony and he also mentioned the mother's notes. He ordered supervised visitation for a two yrs since the first hearing was six month's ago this would be one and half years. The guardian ad litem recommended five months supervised visitation she apparently was not as convinced. I know the judge will always rule on the side of caution. He ruled I should see her every week for one hour. Since I worked a hour and a half away he scheduled it for the weekend. The problem with this there was no facilities open on the weekend. I scheduled to take one half day of every other week to go see her plus they charged me twenty dollars an hour at the supervision facility. Her mother then moved 75 miles away and so I was supposed to drive there for my visitation. Well in this one and half year time I have seen my daughter seven times. Everytime I had it set up her mother would find some excuse to cancel. The order ran out in Oct 1998 but I don't have enough money yet to go back to court so haven't seen her since then. My parents and relatives have not seen her in three years. She was four then now she is seven.
